By completing this rental agreement, you ("Renter") agree to the following terms and conditions set forth by ASC Rentals ("ASC"). These terms constitute a legally binding agreement between you and ASC governing your use of ASC's rental services, equipment, and related applications.
You must be at least eighteen (18) years of age to use this website or rent equipment. By using the ASC Rentals website or mobile application, you warrant that you are at least 18 years of age and have the legal authority to enter into this Agreement. ASC assumes no responsibility for liabilities related to age misrepresentation.
The rented mobility equipment remains the property of ASC Rentals at all times. The equipment is provided in good condition and must be returned in the same condition at the end of the rental period. ASC reserves the right to repossess the equipment without notice if the terms of this agreement are violated.
Rentals are due back at the date and time specified at booking. Extensions must be requested at least three (3) days before the rental expires. If the renter fails to request an extension in time, additional days will be charged at the full-price rack rate. No partial refunds are issued for early returns.
Renter may cancel at any time. A 50% cancellation fee applies unless canceled at least seventy-two (72) hours prior to the rental start date. A 100% cancellation fee applies if the reservation is not canceled at least 72 hours before the rental begins or if the renter fails to pick up or accept delivery of the equipment after requesting it.
A security deposit may be required at the time of booking and will be refunded after a successful return inspection. The renter authorizes ASC Rentals to charge the credit card on file for any damage, theft, or loss of the equipment, as well as for unpaid rental fees or penalty charges. Refunds of security deposits may take three to five (3–5) business days to process, depending on the bank.
ASC Rentals is not responsible for any lost, damaged, or stolen personal property stored, transported, or used with the rented equipment. The renter assumes all risks, liability, damages, injuries, and expenses arising from the use of the equipment. The renter agrees to indemnify and hold harmless ASC Rentals and its affiliates from any claims related to personal injury, damages, or third-party claims, except where such damages arise from gross negligence or willful misconduct by ASC Rentals.
Equipment must not be operated by anyone under the influence of alcohol, drugs, or narcotics, or in a reckless or unsafe manner. The renter must comply with all traffic and safety laws when using any mobility device.
Drop-off and pick-up times must be strictly followed. Standard return time is between 9:00 AM and 12:00 PM unless otherwise coordinated in writing. A $50 missed drop-off or pick-up fee will be charged if the appointment is not met.
A $50 cleaning fee applies if excessive cleaning is required. ASC Rentals will determine if additional cleaning is necessary due to spills, stains, or neglect.
Any modifications to the rental equipment are strictly prohibited. A $75 fee applies if unauthorized modifications are made. Normal seat and handlebar adjustments are permitted.
Rentals are delivered fully charged. The renter is responsible for charging the battery as needed. Out-of-battery assistance fees are $75 during business hours and $100 after hours.
ASC Rentals accepts most major credit cards for payment at the time of rental. A temporary authorization hold may be placed on a debit card for estimated rental charges. Additional authorizations may apply if equipment is not returned on time. ASC Rentals is not responsible for overdrafts or returned checks due to debit holds. Prepaid debit or gift cards are not accepted.
If the renter misses a scheduled drop-off or pick-up, a $50 missed appointment fee applies. Standard return time is 9:00 AM to 12:00 PM unless otherwise coordinated.
Rental extensions must be requested at least three (3) days before expiration. If an extension is not requested in time, additional days will be charged at the full-price rack rate.
Renter agrees to pay all collection costs, attorney fees, and expenses incurred by ASC Rentals in recovering rental fees or compensation for lost or damaged equipment.
The renter is not an employee, agent, or representative of ASC Rentals in any capacity.
All materials, products, software, and services provided through the ASC Rentals website or mobile application are the exclusive property of ASC Rentals, its affiliates, licensors, officers, employees, or agents, including all copyrights, trademarks, trade secrets, and patents. The renter agrees not to reproduce, redistribute, or otherwise use ASC Rentals' intellectual property without prior written consent.
Renter is responsible for all activities that occur under their ASC Rentals account or password. If you believe your account security has been compromised, you must notify ASC Rentals immediately. ASC reserves the right to terminate accounts, modify or remove content, and cancel orders at its sole discretion.
By using the ASC Rentals website or application, the renter agrees not to misuse the platform or engage in any activity that may disrupt its normal operation. ASC Rentals reserves the right to suspend or terminate access to users who violate these terms.
This Agreement shall be governed by and construed in accordance with the laws of The United States of America and its local bodies of government without regard to conflict-of-law principles. Any dispute arising under or related to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located within The United States of America and its local bodies of government.
ASC Rentals reserves the right to modify, amend, or update these Terms and Conditions at any time without prior notice. Continued use of ASC Rentals' services after such modifications constitutes acceptance of the revised Agreement.
This Agreement applies personally to the renter and any affiliated entities. If any provision of this Agreement is deemed unenforceable, the remaining terms shall remain in full force and effect.
By completing checkout, the renter acknowledges that they have read, understood, and agreed to all terms and conditions set forth in this Agreement.
